Separation Agreements are written agreements between married couples which address issues of custody, child support, alimony, health insurance, and property division, among other issues, in anticipation of  divorce or separation.

A carefully drafted Separation Agreement — often the result of thoughtful discussions and negotiations between the parties and their attorneys — will set forth all of the respective rights and obligations of the parties in connection with their divorce, keeping in mind the best interests of the children.   The more issues the parties can agree upon themselves, the fewer issues there are to be determined by the Court. A comprehensive Separation Agreement, which is fair and reasonable and agreed upon by both parties, can eliminate the need for trial, and become part of the final divorce judgment.
